Starting at 13.00, “Urban Transformation” panel directed by Prof. Dr. Rona Aybay. Emphsizing his desire to be the first speaker at the panel, Prof. Dr. Hüseyin Hatemi said that the foundation of this desire is about “Immovable Properties Law”.
Nevertheless speaking about urban transformation briefly, Prof. Dr. Hatemi evaluated urban transformation as the moves by municipalities. Asserting that bribery issues in municipalities legalized, Atemi “Bribery in municipalities are not stonewalled but becomes more rooted, legalized.”
Also he explained the situation in case of action for nullity of urban transformation: “While the action continues, time runs out. While the decision waited, building is pulled down, when the decision for action for nullity comes out, new building is constructed. Investigation can be done to determine whether the building is risky or not.”
Secon speaker at the session Prof. Dr. Özsunay said that apartment ownership and construction ownership are different concepts. Prof. Dr. Özsunay said: “Legists at newspapers dogmatize. Law about urban transformation reach its aim in very few areas. Decisions about risky areas are the tough decisions to be made.”
Last speaker Doç Dr. Zekeriya Kurşat underlined the fact that some problems occurred since urban transformations started and he said: “When we look at Law No 6306, we see three steps. In each steps we see different problem. People who make the construction are given chance to assess the risk. After the risk assessment, registration of these documented as title. After the assessment of the risk, evacuation of the building should be done. Demolishing in prescribed time is essential. This time is 60 days. Expenditure of demolishment is covered by owner. If the demolishment is done by administrative chief, expenses are covered by administrative chief. Building reinforcement is added to law besides the option of demolishment. This has specific rules.”
